OSUN NBA DRAGS AREGBESOLA, CJ TO COURT OVER HIKE IN FILING FEES

[Osun]–The Nigeria Bar Association, Osun-State branch has dragged the Governor of Osun-State, Mr. Rauf Aregbesola, Chief Justice and others to court over hike in filing fee in the state. 

The Scores of the member of the NBA appeared before Federal High Court Osogbo on Tuesday morning.

The Counsel representing the Nigeria Bar Association, Osun-State, Mr. Yinka Sokoya informed the court that they sought to maintain status quo with regards to the filing fees in the state.

Sokoya told the court that ” A  circular was passed to us dated 24th of February 2017, signed by one Taiwo Jacob of High court of Osun-State which is part of the respondent.

We have filed our motion and affidavit on 2nd March 2017 for maintenance of status quo and suspension of all action of proceedings and implementation of a circular dated 24th of February, 2017, pending the determination of the court”.

Sokoya prayed the court for a stand down of the circular.

The court which was presided over by Justice Maureen Adaobi Onyeten denied the request of the plaintiff and she requested for the circular telling the counsel that she must go through it before any decision can be made.  She also asked the counsel to do the proper filing of the circular as she adjourn the case till 8th of March 2017.

After the court sitting, the chairman of NBA Ilesha, Mr Ebenezer Ogunfunminiyi told journalist that ” the battle between NBA and the state government is a battle of wit and we came here so that the implementation of the circular that was sent to us should not be implemented until court decide.”

He added, “The circular sent to us is so bad that if you have a claim of N200 and an application wanted to be filed before the court the person have to pay N2,500 which made the fees so outrageous.

Also, part of the content of the circular is the Matrimonial Causes Acts and rules which are Federal enactment, the Governor or even the Chief Justice of Osun-State can not make rules for such.”
